The United Nations Development Programme’s (UNDP) “A Transparent and Accountable Judiciary to Deliver Justice for All” is a report assembled in collaboration with the U4 Anti-Corruption Resource Centre that advocates combating corruption through judicial integrity and independence. According to this report, the judiciary is globally perceived as the second-most corrupt sector after the police. Because an independent and impartial judiciary is foundational to the rule of law, when a judiciary is corrupt, “the very principles of fairness and due process of law” are undermined, leading to the erosion of the rule of law and the judiciary itself within a country. While there are multiple international standards on judicial integrity that safeguard against judicial corruption, successful implementation of these standards has proven to be especially challenging. Subsequently, in recent years, successful implementation has become the major focus in improving judicial integrity and independence globally. Drawing on lessons from judicial reform efforts from a range of countries in various regions, including South Asia and the Pacific, Sub-Saharan Africa, and South America, this report outlines ways in which judiciaries can successfully implement concrete changes to foster judicial integrity and independence.
This report suggests that strengthening judicial oversight mechanisms may provide a way to help strike a balance between judicial independence and accountability. Judicial oversight mechanisms such as judicial councils, codes of conduct, and the vetting of judges may serve as tools to help prevent undue influence and interference from outside parties like the the government. In some countries, particularly those in transition from authoritarian regimes, prioritizing the separation of powers is key and may require drastic measures such as acquiring an entirely new judicial staff. Ultimately, judicial oversight measures equip judiciaries with the tools to regulate themselves internally and help to ensure accountability. Codes of conduct provide a way to monitor staff behavior while judicial honor councils or other similar structures can ensure that misconduct is appropriately addressed and penalized.
Furthermore, the advent of technology can make major advancements in improving transparency and access to justice, also serving to increase accountability, legitimacy, and public confidence in the judiciary. Technology has the capacity to enhance the effectiveness of the judiciary and improve judicial integrity through the automation of court services and administration. Decreasing the level of human interaction throughout phases of the judicial process may help to reduce opportunities for corruption while digitizing court documents and proceedings can improve transparency and public confidence in the court systems. Additionally, providing the public with digital access to judicial verdicts and other court information opens up judicial behavior to public scrutiny, promoting greater transparency and accountability. Simultaneously, improved digital access to court documents may lead to a more informed citizenry, promoting greater involvement in civil society and encouraging citizens to be more engaged and demanding of justice from their judiciary. While this report does not claim technology to be a panacea for improving judicial integrity and independence, it does suggest that technology may provide significant advancements on the path to this goal.
Finally, this report suggests that initiatives that involve the community, such as trial monitoring and others, may help increase judicial accountability. At the center of such mechanisms is the broader necessity for increased awareness and overall access to justice in order to kick-start bottom-up approaches to improving judicial accountability, and thereby improving judicial integrity and independence.
